By using the services provided by the company EasyBroadcast SAS ("EasyBroadcast"), you agree to have read these terms and conditions of sale and use and have accepted them.

1. The Service

EasyBroadcast will provide the service in accordance with this agreement. You agree to agree to the terms and conditions of this Agreement in order to use the services, otherwise EasyBroadcast may cease distribution of the services or change them without notice.

The use of the services requires one or more supported devices, connected to an internet network. It may also require updates or upgrades. The quality-of-service usage may be affected by the performance of these factors. High-speed Internet access is recommended.

2. Account creation

An account must be created in order to use the services. The user is asked to provide some personal information such as name, email, etc... In this case, you agree to provide accurate information. You will also be asked to provide a username and password for which you are exclusively responsible for maintaining its security.

3. Content and Communication Responsibility

You agree that you are exclusively responsible for any content uploaded, sent or displayed during the use of the Services.

You agree that you will not use the Services in a criminal manner, but will comply with all laws, including anti-spam laws and regulations, export control laws, privacy laws, and anti-terrorism laws. You agree that you are the only responsible for complying with these laws and regulations.

You consent that you will not use the services to communicate content that is harassing or threatening, content that may violate the intellectual property of a third party, or provide support or resources to organizations designated by the French government as a terrorist organization.

You agree that you will not upload or download any software that may damage, disable or deteriorate the quality of the services.

EasyBroadcast reserves the right to react to any violations of its conditions and to notify the authorities.

EasyBroadcast is under no responsibility for content in violation of this clause and reserves the right to remove any content without notice.

The host can choose to record meetings. By making this choice, you allow EasyBroadcast to keep recordings for one or more meetings. When recording is enabled, you will receive a visual and/or audio notification.

4. Responsibility for third party content

In case of a violation of the terms and conditions of this agreement by a third party, EasyBroadcast disclaims all responsibility.

You may contact EasyBroadcast if you become aware of or witness any violation of this Agreement in the use of the Services. EasyBroadcast will take appropriate steps to investigate violations including sending warnings, removing content or deleting user accounts and profiles.

EasyBroadcast is not responsible for any data in violating this provision and may remove any suspicious content without notice.

5.Eligibility

You confirm that you are over the age of majority and fully competent to enter into the terms and conditions and respect the whole of the present agreement. Access may be suspended without notice if we believe that you are a minor or otherwise ineligible.

6. Usage restriction

The services must only be used for your business activities or for personal use.

In no case, you will resell or reproduce EasyBroadcast services. Only a separate agreement with EasyBroadcast can allow you to do this.

In addition, you will not use EasyBroadcast services in any way that may damage or affect their quality or disrupt servers connected to EasyBroadcast services or EasyBroadcast security systems.

8. Fees and subscription

You agree that EasyBroadcast may charge your credit card or other means of payment accepted by the site, fees related to your use of the services.

If EasyBroadcast is unable to charge the fees related to your account, EasyBroadcast may take such other steps as it deems necessary to charge you for such fees, and you will be responsible for all fees and charges related to such collection activity (including collection fees, attorneys' fees and expenses).

You also agree that EasyBroadcast may charge interest on amounts unpaid at expiration.

You may cancel your subscription at any time without cancellation fees when it is a no-commitment package. Just write to support@easybroadcast.fr

If you choose a package with a one-year commitment, cancellation is always possible by contacting support@easybroadcast.fr

EasyBroadcast will not refund the duration of the services you have already paid for. If you are on a monthly payment plan, the remaining monthly amount must be paid.

9. Withdrawal period

The withdrawal period allows all consumers to have a period of 14 days to change their mind in case of purchase by internet.

To do this retraction, please contact EasyBroadcast: support@easybroadcast.fr.

After using your right of withdrawal, you will be refunded the full amount you have paid for this product, without undue delay and no later than 14 days from the date EasyBroadcast is informed of your decision. (Article L221-24 of the Consumer Code).

The refund will be made by the same type of payment that you used for the purchase (credit card), except if you agree to be refunded by another means that does not incur additional costs for you.

10. Resiliation

The website(s) of the Services contains all the information for the resiliation of your subscription, if you purchase a package with commitment, this resiliation will take effect on the last day of the term specified in the subscription, the order form may provide for an automatic renewal of the period unless notice of termination issued less than 30 days before the start of the new renewed period.

If you do not comply with or agree to the terms of this agreement, EasyBroadcast may terminate your account and retain all amounts that have already been paid.

Upon termination you must cease using the Services and destroy all copies of the associated software that you have under your control.

11. Copyright

You may not publish, modify, distribute or copy any material protected by copyright, trademark, publicity rights or any other proprietary right without the written consent of the owner of the rights.

EasyBroadcast may deny access to the services to any user suspected of violating the copyright of a third party. If you believe that your copyrights have been violated, please provide the following information to our managers:

1.An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright; 2. A description of the copyrighted work that you claim has been infringed; 3. A description of the location on the Services of the infringing content; 4. Your address, telephone number, and email address; 5. A written statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; 6. A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

If your content is deleted during this process, you will receive information on how to file a notice of dispute. Notices and counter-notices are notices of regular activities or communications related to the Services. Therefore, they are not subject to EasyBroadcast's Privacy Policy. This means that EasyBroadcast may publish or share them with third parties at its discretion, and may use them for its prior communication.

12. Liability Limitation

EasyBroadcast is in no circumstances liable for any incidental, consequential, special or consequential damages; loss or damage to data or interruption or loss of business; or loss of revenue, profits, business, sales or expected savings.

EasyBroadcast's maximum cumulative liability to you, whether under contract, warranty or otherwise (including negligence), shall not exceed the total amount paid by you for the Services during the twelve (12) months prior to the initial claim.

13. Property rights

EasyBroadcast retains all rights to its services and all associated or displayed domain names, trademarks and logos. You may not use any other proprietary information (including images, text, layouts or forms) unless you are authorized to do so by agreement with EasyBroadcast.

You are not authorized in any way to proceed with their representation, reproduction, broadcast or replay, in accordance with Articles L.713-2 and following of the Intellectual Property Code.

You will not generate any revenue through the Services and will not allow third parties to use the Services you have purchased.

14. Privacy

In the context of its activities and in accordance with the regulations applicable in Europe, in particular the EU General Regulation on Data Protection, EasyBroadcast is committed to ensuring the protection, confidentiality and security of its users' personal data, as well as to respecting their privacy.

The personal data protection policy applies to the collection and processing of data on the online site and the online application for smartphones, tablets and other connected mobile devices.

The personal data protection policy can be modified. It is specified that EasyBroadcast may modify the personal data protection policy at any time, including to adapt it to current legislation. The user will be informed of such changes. We recommend that you regularly check the current version available.

The personal data protection policy defines the main principles and methods of data processing.

15. Guaranteed

EasyBroadcast does not and will not provide any warranty of merchantability, suitability for a particular purpose or the non-violation of intellectual property rights. EasyBroadcast makes no warranties or representations regarding the accuracy of the results that may be obtained from the use of the services, or the reliability of the information obtained through the services. You assume responsibility for all risks associated with the use of the services. Any concealment of information or communication between users is not the responsibility of EasyBroadcast, and EasyBroadcast cannot guarantee accurate results from the use of the services.

You agree to compensate, defend, and hold harmless EasyBroadcast, its officers, directors, employees, consultants, agents, and resellers, from and against any and all claims, liabilities, or damages, related to your use of the Services, a violation of this Agreement by you or any other person using your account.

EasyBroadcast does not allow the use of the services in dangerous environments that require security screening including nuclear facilities, air traffic control, life support equipment or weapons systems and aircraft navigation or communication systems.
